Introduction

By using the BookMyStay platform, the user agrees to be bound by these Terms and Conditions in their entirety.

Platform Overview

• BookMyStay serves as an online platform that facilitates short-term rental bookings between hosts and guests. It does not own, manage, or operate any of the properties listed on the platform.
• All agreements and legal relationships regarding stays are formed directly between the host and the guest. BookMyStay is not a party to any rental agreement.

User Requirements

• Users must be at least 18 years of age and legally competent to enter into binding contracts under applicable laws.
• Users must create an account with accurate, complete, and up-to-date information and are responsible for maintaining the confidentiality of their login credentials.

Bookings and Payments

• Bookings are subject to host acceptance and property availability. BookMyStay reserves the right to cancel or refuse any booking in accordance with platform policies.
• All prices are displayed in Pakistani Rupees (PKR) and include applicable service fees and taxes, unless stated otherwise.
• Payments are processed securely through Pay Fast. BookMyStay shall not be liable for payment processing errors or payment service disruptions.

Cancellation Policies

• Guests may cancel bookings in accordance with the cancellation policy selected by the host on the property listing.
• Refunds, if applicable, shall be processed within 2 to 3 business days.
• Hosts may choose from flexible, moderate, or strict cancellation policies, which must be clearly stated on each listing. Guests are advised to read these terms before booking.

Host and Guest Responsibilities

• Hosts must provide accurate descriptions, photographs, pricing, and terms of stay. Misrepresentation or fraud may result in removal from the platform and legal action.
• Hosts are responsible for ensuring that their properties are safe, clean, and in compliance with all local laws, health codes, and zoning regulations.
• Guests must comply with house rules, local laws, and community standards. Violations may result in immediate removal, fines, or legal consequences.
• Guests are financially liable for any property damage, loss, or violations of house rules during their stay.

Platform Usage

• Users are prohibited from bypassing the platform to conduct direct bookings or solicit off-platform payments.
• Users shall not upload or distribute content that is defamatory, misleading, infringing, or unlawful in nature.
• Reviews and ratings submitted by users must reflect honest experiences. Fraudulent reviews will be removed, and offending users may be suspended.

Liability and Legal

• BookMyStay disclaims all express or implied warranties related to uninterrupted platform operation, merchantability, fitness for a particular purpose, or non-infringement.
• BookMyStay shall not be liable for indirect, incidental, or consequential damages arising out of guest-host disputes, property issues, cancellations, or service interruptions.
• The total liability of BookMyStay for any claims shall be limited to the amount paid by the user to BookMyStay within the past 12 months.
• Users agree to indemnify and hold harmless BookMyStay and its affiliates against any claims, damages, or legal fees resulting from their misuse of the platform or violation of these terms.
• BookMyStay reserves the right to amend these Terms and Conditions at any time. Continued use of the platform following notice of changes shall constitute acceptance of the revised terms.
• These Terms and Conditions are governed by the laws of the Islamic Republic of Pakistan. Any disputes shall be subject to the exclusive jurisdiction of the courts in Islamabad.
• If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
